Michael McCarty is a Principal in the firm of Brickfield, Burchette, Ritts & Stone, P.C. who specializes in water and energy law, with a particular emphasis on hydroelectric licensing and compliance, electric energy regulation, water resources development and regulation, the Endangered Species Act, and related civil and administrative litigation. He also serves as General Counsel to American Medical Technologists, a certification and membership association for allied health professionals.
Mr. McCarty is a graduate of the University of Virginia (B.A. with Distinction, 1976) and Catholic University Law School (J.D. 1979), where he was elected as an executive editor of the Law Review. Upon graduation from law school, he served a judicial clerkship with Judge Stanley S. Harris of the District of Columbia Court of Appeals. Since entering private practice in 1980, Mr. McCarty has represented numerous entities, mostly municipal and other public bodies, in hydroelectric, electric rate, and transmission matters before the Federal Energy Regulatory Commission (FERC) and other federal agencies and courts. In recent years a significant part of his practice has involved representation of hydropower producers and contractors in judicial and regulatory proceedings arising under the Endangered Species Act. He also represents public agencies and special districts in connection with their acquisition of power and transmission from federal power marketing administrations.
Mr. McCarty has litigated energy-related cases before federal courts in California, Colorado, Arizona, Nevada, and the District of Columbia. In addition to the federal district courts in those jurisdictions, Mr. McCarty has been admitted to practice and has argued cases before the U.S. Court of Federal Claims and the U.S. Courts of Appeals for the Ninth, Tenth, District of Columbia, and Federal Circuits. He also is admitted to the Bar of the U.S. Supreme Court.
Michael is a member of the National Hydropower Association and the Energy Bar Association (EBA), and is a past-Chair of the EBA Committee on Hydroelectric Regulation.
In addition to his regulatory, transactional and litigation practice, Mr. McCarty advocates his clients' interests before the U.S. Congress and state legislature.
